Whatever you do, whatever chance you may have, you had better settle with Obama before a case reaches the courts, because like with Keller and Keller, you have no chance whatsoever. How is he so successful? Is it his skill at taking the position which is legally impervious to any argument? Hardly.
The secret to his success lies in the fact that he can make up the rules to suit him as he goes. It’s not hard to win when you’re like the Queen holding court for Alice in Wonderland. How can you lose when you impose your legal views on America and force feed your stance? The oddity is that is has taken so many different twists and turns.
In Arizona, we have Barack taking the stance that not only will the Federal Government not enforce our immigration laws or our borders but he also will not allow any state to do it. Trouble lies on the horizon as other states will be entering the fray taking stances much closer to that of Arizona (see Virginia and Oklahoma for example).
In the Gulf Region, Barack gets told that his job killing moratorium on deep water drilling is not legal but that does not stop him-- no sirree. Instead, he just changes it up a little and whammo! Bang! you have a new moratorium. Never mind that it may kill tens of thousands of jobs; what is paramount is that the Obama legal mind has prevailed over all foes.
In still another battle Barack faces off against those who oppose the cap and trade. Here, he bypasses the legislature, avoids the courts, and puts his stamp on this issue by doing an end around with the EPA spearheading the cause. We’ll just dispense with legalities and discussions and allow the EPA to rain down edict upon edict to enforce the Obama mindset.
Lastly, Obama has “lost” in court over the issue of stem cell research. He’s been told by a court that there is no distinction as to which embryos (live or dead) will be used and so federal funds cannot be used for this purpose. Alas, Obama has the last laugh as funds have already been disbursed so in his eyes it is too late and once again he has gotten his way.
Yes, at the end of the day Obama has “won” many legal victories, but the public is surely not supporting his stances. He is in the minority view on so many issues that one would believe that he is happy to get a 30% popular support for how he sees things. He must keep in mind that no court will help him when he may well get a minority portion of the vote come 2010 and 2012.
